THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.

Under and by virtue of the Power of Sale contained in a Security Deed from Samantha Ann Jenkins to Kermit Hill, dated October 31, 2016, recorded November 7, 2016, in Deed Book 862 page 731, Murray County Deed Records, (the “Security Deed”) conveying the within described property to secure a Note in the original principal amount of $59,000.00, with interest thereon on the unpaid balance until paid as set forth therein, (the “Note”), there will be sold by the undersigned at public outcry to the highest bidder for cash in the designated area within the courthouse at the Murray County Courthouse, Murray County, Chatsworth, Georgia, within the legal hours of sale on the first Tuesday in June, 2022, the following described property:

ALL that tract or parcel of land lying and being in Land Lot 135 and 136 in the 8th District and 3rd Section of Murray County, Georgia, designated as Tract 87 and Tract 88 of Oak Hills Plat 3, containing 4.69 acres, more or less, as shown on a plat of survey thereof prepared by Leon Pritchett, Murray County Land Surveyor, dated 9/20/1988, and recorded in Plat Book 21 page 151, in the Office of the Clerk of the Superior Court of Murray County, Georgia, which plat is hereby incorporated herein by reference thereto for a more particular description of said property.

TOGETHER WITH that certain 1998 Double Wide Buccaneer Mobile Home having a manufacturers identification number of ALBUS-27416 AB also known as ALBUS27416A and ALBUS27416B. See Mobile/Manufactured Home Certificate of Permanent Location recorded in Deed Book 739 page 476, and in Deed Book 739 page 478, Murray County Deed Records.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).

PLEASE NOTE THAT THIS INDEBTEDNESS IS SUBJECT AND INFERIOR TO A FIRST PRIORITY DEED TO SECURE DEBT IN FAVOR OF THE SAME LENDER IN THE ORIGINAL PRINCIPAL AMOUNT OF $60,974.83 PER SECURITY DEED FILED AND RECORDED IN DEED BOOK 6554, PAGES 252-257 WHITFIELD COUNTY DEED RECORDS.

Said property will be sold as the property of Samantha Ann Jenkins and subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, easements, rights of way, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed.

To the best knowledge and belief of the undersigned, the party in possession of the said property is Samantha Ann Jenkins or a tenant or tenants and said property is more commonly known as 300 Bent Oak Drive, Chatsworth, Georgia 30705. Said property also has Murray County Tax Parcel Number of 0035 229.

Notice has been also given, in writing and by certified mail, return receipt requested, to Samantha Ann Jenkins, of the name, address, and telephone number of the individual or entity who shall have full authority to negotiate, amend, and modify all terms of the Security Deed and the Note thereby secured in accordance with O.C.G.A. Section 44-14-162.2, said person being Eddie Oquinn, as Executor of the Estate of Kermit Hill, deceased whose mailing address is 158 Paint Horse Lane, Clintwood, Virginia 24228 and whose phone number is 276-835-9332.

This sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed, which holder is Eddie Oquinn, as Executor of the Estate of Kermit Hill, deceased.
