NOTICE OF SALE UNDER POWER
STATE OF GEORGIA,
COUNTY OF MURRAY.
By virtue of the power of sale contained in that certain Deed to Secure Debt (the “Security Deed”) executed by Alan Chastain Clark dated June 19, 2014, and recorded in Deed Book 812, Page 285, Murray County, Georgia Deed Records, and by virtue of a default in the payment of the indebtedness referred to in said Security Deed and secured thereby, Dawn H. Patterson, as attorney-in-fact for Alan Chastain, will sell before the courthouse door in Chatsworth, Murray County, Georgia, within the legal hours of sale, for cash, to the highest bidder, on the first Tuesday in March, 2021, the following described property:
All that tract or parcel of land lying and being in Land Lot No. 190 of the 9th District and 3rd Section of Murray County, Georgia, and being Lot No. 13 of the Thomas W. Williams Estate, according to a plat of said property prepared by E. M. Smith, Georgia Registered Land Surveyor, dated March 2, 1967, of record in Plat Book 3, Page 170 in the Office of the Clerk of the Superior Court of Murray County, Georgia, reference to said plat being herein made for a full and complete description of the land. Being that identical property conveyed to Anton Kolb by Warranty Deed of record in Deed Book 157, Page 218, Murray County, Georgia Land Records.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of indebtedness secured by the Security Deed. Said indebtedness remaining in default, this sale will be made for the purpose of paying said indebtedness and all expenses of sale including advertising costs and attorney’s fees, as provided for in said Security Deed.
Said property will be sold subject to the outstanding balances of all liens and encumbrances, if any, superior to the Security Deed. Said property will further be sold subject to any outstanding and unpaid ad valorem taxes and/or assessments for street or other public improvements assessed by any governmental authority and/or easements and/or restrictive covenants appearing of record or existing as a matter of fact, if any, and will be sold subject to any zoning ordinances or other governmental regulations, if any, affecting said property.
The property described above will be sold as the property of Alan Chastain. To the best knowledge, information and belief of the undersigned, the aforesaid are now the owners of the equitable title to said property.
