NOTICE OF SALE UNDER POWER

COUNTY OF MURRAY

STATE OF GEORGIA

By virtue of the power of sale contained in the Deed to Secure Debt (hereinafter “Deed”) from Bellissimo Springs, LLC (“Borrower”), to BarRog Investments, LLC dated September 21, 2020 and recorded in Deed Book 962 Page 637, Deed Records of Murray County, Georgia, said Deed being given to secure certain indebtedness referred to therein, including, but not limited to, a Note in the original principal sum of $1,230,000.00 any renewals thereof, plus all accrued interest, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door in Murray County, Georgia within the legal hours of sale on the first Tuesday in March 2021 (to wit: March 2), the following described property:

Tract No. 1:

All that tract or parcel of land lying and being in Land Lot No. 242 of the 10th District and 3rd Section of Murray County, Georgia, being more particularly described according to a plat of survey prepared by Marcus Eugene Cook, Georgia Registered Land Surveyor No. 1935, dated September 12, 2003 and recorded in Plat Book 39 Page 90, Murray County, Georgia Land Records, reference to which plat is hereby made and incorporated herein by reference for a more particular description of said land.

Together with and subject to a perpetual non-exclusive easement for ingress, egress, and utilities along the existing driveway, expressly reserved hereby.

Tract No. 2:

All that tract or parcel of land lying and being in Land Lot No. 242 in the 10th District and 3rd Section of Murray County, Georgia and being Tract No. 1 as shown on a plat of survey prepared for Marilyn McGhee Brown by N.B. DeLoach, Georgia Registered Land Surveyor, dated July 30, 1996, revised August 31, 1996, and recorded in Plat Book 30 Page 143, Murray County, Georgia Land Records, reference to which plat is hereby made and incorporated.

LESS AND EXCEPT that portion of the above described property described in that certain Warranty Deed from Edward Chapman and Anita S. Chapman to Sparkle Spring Water, Inc., dated July 12, 2004, and recorded in Deed Book 535 Page 532, Murray County, Georgia Records.

LESS AND EXCEPT that portion of the above described property in that certain Warranty Deed from Edward Chapman and Anita S. Chapman to Brent Harrison, Angela Harrison and Deborah Welch, dated August 8, 2006, and recorded in Deed Book 608, Page 255, Murray County, Georgia Records.

For prior title see Deed Book 960 Page 260, Murray County, Georgia Land Records.

Together with all machinery, equipment, fixtures and other property, attached to and constituting a part of said real property described as Tract Nos. 1 and 2 above.

The indebtedness secured by said Deed having been and are hereby accelerated and declared due because of, among other possible events of default, failure to pay in accordance with the terms of said Deed and/or Note. Said indebtedness remaining in default said sale will be held as provided by law and under the terms of said Deed. The proceeds of said sale shall be applied to the payment of said indebtedness, the expenses of this proceeding, including but not limited to, attorney’s fees, and all other payments as provided for under the Deed, Note and by law.

Notice has been given of the intention to enforce provisions for collection of attorney’s fees and foreclosure in accordance with legal requirements and the terms of said Deed and Note.

Said property will be sold subject to all outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, lien for unpaid utility and water bills, and other matters of record superior, if any, to the Deed and the sale will be conducted subject to confirmation that it is not stayed under the U.S. Bankruptcy Code and to final audit and confirmation of the loan with the holder of the Deed.

To the best knowledge, information and belief of the undersigned, said property, sometimes commonly known as 9060 and 9064 Hwy. 225 N, Chatsworth, GA 30705 is in the possession of Bellissimo Springs, LLC, or tenants, and will be sold as the property of Bellissimo Springs, LLC
