NOTICE OF SUMMONS
PURSUANT TO APPLICABLE GEORGIA STATE LAW
TO: HEATHER DAVIS, CURT PATTERSON AND RICKY AUSMUS AND ANY UNKNOWN, UNNAMED PUTATIVE BIOLOGICAL FATHERS OF ABOVE-MENTIONED CHILDREN
You are hereby notified that a Petition seeking to terminate your parental right to the above-named child(ren) was filed in the Juvenile Court of Murray County, Georgia, on January 21, 2020. The grounds for termination are that the child(ren) is/are a dependent child(ren) under O.C.G.A. 15-11-2 and O.C.G.A. 15-11-310. A copy of the Petition may be obtained from the Office of the Clerk of the Murray County Juvenile Court located at 121 N 4th Avenue, Chatsworth, Murray County, GA. You are hereby notified that you are required to appear before the Juvenile Court of Murray County, Georgia in Chatsworth, Georgia on the 2nd day of June, 2020, at 2:30 p.m. should you desire to contest the Petition. If you fail to appear, the court can terminate your rights in your absence. The effect of the termination filed shall be to terminate your parental rights with respect to the minor child(ren). This means you will not have the right to visit, contact, or have custody of your child(ren) or make any decisions affecting your child(ren) or your child(ren)’s earnings or property. Your child(ren) will be legally freed to be adopted by someone else. Even if your parental rights are terminated: (1) you will still be responsible for providing financial support (child support payments) for your shild’s care unless and until your child(ren) is/are adopted; (2) Your child(ren) can still inherit from you unless and until your child(ren) is/are adopted.
The biological father of said child is hereby notified that he will lose all rights to the child and will neither receive notice nor be entitled to object to the adoption of the child unless, within thirty (30) days of his receipt of this notice, he files a petition to legitimate the child pursuant to O.C.G.A. 19-7-22, as well as a notice of the filing of the petition to legitimate with the Juvenile Court of Murray County, with a copy of said notice of filing being sent to Attorney Joye Thomas Wills, P.O. Box 18, Cohutta, GA 30710.
Should he fail to file a petition to legitimate the child and give notice as required within thirty (30) days of his receipt of this notice or, if after filing the petition to legitimate he fails to obtain a final judgement granting the petition, he will lose all rights to the child and the Court shall enter an Order terminating all of his rights to the child and he may not thereafter be entitled to receive further notice nor be entitled to object to the adoption of the child(ren).
THE RESPONDENT IS HEREBY CONSIDERED NOTIFIED AND SERVED BY PUBLICATION PURSUANT TO GEORGIA LAW AND IS REQUIRED TO NOTIFY THE CLERK OF MURRAY COUNTY UPON RECEIVING SAID NOTICE.
