NOTICE OF SALE UNDER POWER
STATE OF GEORGIA, COUNTY OF MURRAY
By virtue of a Power of Sale contained in that certain Security Deed from Edward Moree and Sandra Moree to Associates Financial Services of America, Inc., dated November 10, 2000 and recorded on November 17, 2000 in Deed Book 366, Page 35, in the Office of the Clerk of Superior Court of Murray County, Georgia, said Security Deed having been given to secure a Note of even date, in the original principal amount of One Hundred Eighty-Eight Thousand Nine Hundred Eighty-Five and 69/100 dollars ($188,985.69) with interest thereon as provided therein, as last transferred to 1900 Capital Trust III by U.S. Bank Trust National Association not in its individual capacity but solely as certificate trustee, recorded in Deed Book 927, Page 393, aforesaid records, will be sold at public outcry to the highest bidder for cash before the courthouse door of Murray County, Georgia, or at such place as has or may be lawfully designated as an alternative location, within the legal hours of sale on the first Tuesday in February, 2020, all property described in said Security Deed including but not limited to the following described property:
ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOTS 68 AND 77 OF THE 8TH DISTRICT, 3RD SECTION, MURRAY COUNTY, GEORGIA, AND BEING LOT NUMBER 4 AS SHOWN ON PLAT NUMBER 2 FOR WILLIAM H. CHENEY DATED FEBRUARY 13, 1986, BY BAKKUM-DELOACH & ASSOCIATES, INC. AND RECORDED IN PLAT BOOK 16, PAGE 204, MURRAY COUNTY, GEORGIA, RECORDS } ALSO INCLUDES: 1-1995 GILES KENTUCKIAN MOBILE HOME SER#13229TN. 1-1995 GILES KENTUCKIAN MOBILE HOME SER#13224TN. 1-1995 GILES KENTUCKIAN MOBILE HOME SER#13225. 1-1995 GILES KENTUCKIAN MOBILE HOME SER#13226TN. 1-1980 BONNELL MOBILE HOME ID#1428. 1-1981 VEGA MOBILE HOME ID#4-8-54P. 1-1996 GILES KENTUCKIAN MOBILE HOME SER#GI16341. AND: ALL that tract or parcel of land located in Land Lots Nos. 264 and 277 In the 9th Distant and 3rd Section of Murray County, Georgia, designated as Lots Nos. 53 and 54 of Fox Fields Subdivision, as shown on a plat of survey thereof prepared by Joseph R. Evans, Georgia Registered Land Surveyor No. 2168, dated August 18, 1988, and recorded in Plat Book 20, page 115, in the Office of the Clerk of Superior Court of Murray County, Georgia, reference to which is herein made for a more particular description of said property. SUBJECT to Restrictive Covenants recorded in Deed Book 142, Page 792, Murray County Deed Records. SUBJECT to all restrictions and easements of record that may affect the subject property.
Said property may more commonly be known as 13 Mountain View Circle, Chatsworth, GA 30705.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
The individual or entity that has full authority to negotiate, amend and modify all terms of the loan is Shellpoint Mortgage Servicing, 55 Beattie Place, Suite 100 MS 561, Greenville, SC 29601, 1-800-365-7107.
Said property will be sold on an “as-is” basis without any representation, warranty or recourse against the above-named or the undersigned. The sale will also be subject to the following items which may affect the title: a) zoning ordinances; b) matters which would be disclosed by an accurate survey or by an inspection of the property; c) any outstanding ad valorem taxes, including taxes, which constitute liens upon said property whether or not now due and payable; d) special assessments; e) the right of redemption of any taxing authority; f) all outstanding bills for public utilities which constitute liens upon said property; g) all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Security Deed. To the best of the knowledge and belief of the undersigned, the owners and party in possession of the property are Edward Moree and Sandra Moree and or tenant(s). The sale will be conducted subject to 1) confirmation that the sale is not prohibited under the U.S. Bankruptcy code and 2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
